Mocobizscene- Rev. Dr. Jeff Hood, Kenneth Smith’s spiritual advisor, filed a complaint against Alabama Department of Corrections officials, alleging they violate Smith’s right to religious freedom. If Smith’s lawsuit is successful, it will occur before his execution, making him the first prisoner in the US to be put to death by nitrogen hypoxia.
Hood contends that he was forced to sign a disclaimer that restricts his options in the execution chamber, calling the three-foot rule one of “tyranny of vagueness.” A Supreme Court decision from last year requiring states to grant death row convicts’ requests for their pastors to pray over and touch them during their executions may lend credence to the lawsuit.
The Alabama Department of Corrections chose not to comment regarding the ongoing legal dispute. The date of Smith’s execution is set for January 25.
