Woman’s car sustains significant damage due to road divot, but state denies her claim for compensation

Versie Lewis claims that the damage inflicted upon her car has resulted in a significant financial burden, amounting to thousands of dollars.

Lewis expressed his frustration, stating, “I now have to make monthly car payments, and on top of that, my insurance rates are increasing.”

During her interview with Channel 2 investigative reporter Ashli Lincoln, she recounted her experience of traveling westbound on Interstate 285 near Old National Highway. She revealed that she had to abruptly veer onto the shoulder due to a speeding car.

She said it was still dark, resembling the early hours of six in the morning.

She noticed the divot only after it was too late.

“We encountered a pothole on the road, causing the dogs to tumble off the back seat. My daughter’s head unintentionally collided with the roof of the car, leaving us all quite startled and rattled,” Lewis recounted.

Her car came to a sudden halt just moments later.

She said, “I could only coast over to the side of the road.”

Lewis filed a claim for damages exceeding $9,000 with the State’s Department of Administrative Services, which is responsible for reviewing claims from car owners whose vehicles have been affected by Georgia’s roads.

She stated that after reviewing her paperwork, both from Geber and her insurance company, they concluded that they were not responsible for it in any way.

Her insurance company totaled her car after the state denied her claim.

In 2023, Channel 2 Action News revealed that the state had a disheartening track record when it came to compensating road damage claims. Shockingly, less than 30% of the reported claims were actually paid out. Out of the 1,486 claims that were closed, a meager 378 cases received any form of payment from the state. This alarming statistic sheds light on the dire situation faced by individuals seeking reimbursement for road damage.
