Individual accused of strangulation surrenders right to a prompt trial

The perpetrator of a strangulation incident near Spencerville earlier this year was requested by the alleged victim to be kept behind bars for as long as possible during a hearing in Lima on Monday. Prosecutors have accused the individual of the crime.

At a pre-trial hearing for Ty Shellenbarger Jr., 20, from rural Spencerville, a request was made. Shellenbarger had been indicted by a grand jury in June on one count of strangulation, which is a third-degree felony. During the hearing held on Monday, Shellenbarger agreed to waive his constitutional right to a speedy trial and accepted a continuation of his trial date until September 24th.

At present, Shellenbarger remains in custody at the Auglaize County jail with a bond amounting to $150,000 for cash or surety. His legal counsel, Scott Kelly, has requested Judge Jeffrey Reed to review the bond and possibly reduce it. However, if the bond is posted, it will come with certain conditions, including house arrest and the use of a GPS ankle monitor. On the other hand, Assistant Prosecutor Joe Everhart from the state of Ohio argued that the current bond amount is fitting for the case.

During the court hearing, Everhart requested to hear from the supposed victim in the case. The young girl, who appeared to be of small build, spoke directly to the judge and urged him to keep Shellenbarger’s bond at the same level as before. She revealed that the assault on her was not a one-time occurrence.

The girl expressed her fear and uneasiness about the release of the person in question from jail. She revealed that she does not feel safe and is uncertain about the future. She went on to state that she does not believe that this will be the last time she will experience such a situation. The girl expressed her lack of trust and her feeling of terror towards the individual.

Shellenbarger’s bond was reduced to $100,000 cash or surety by Reed, who also mandated house arrest and electronic monitoring if the bond is posted.

Court records indicate that on May 5th, the Allen County Sheriff’s Office received a report of an assault and strangulation of a female at 1250 S. Sunderland Road in Spencerville. The mother of the victim informed the deputies that her daughter had texted her for help and asked to be picked up from Shellenbarger’s residence.
