Democratic lawmaker proposes resolution to censure Justice Alito for displaying upside-down flag

A Tennessee Democrat has taken action by introducing a resolution in the House to censure Supreme Court Justice Samuel Alito. This comes after reports emerged that an upside-down flag was flown outside his residence shortly following the riot on the Capitol on January 6, 2021.

Rep. Steve Cohen, a member of the Judiciary Committee, introduced a censure resolution on Tuesday. The resolution accuses the individual of knowingly violating the federal recusal statute and binding ethics standards. It further states that this violation raises concerns about the impartiality of the Supreme Court of the United States.

Justice Alito has consistently maintained that he had no involvement in the act of flying the upside-down flag outside his home in January 2021. He attributes the action to his wife, stating that she briefly placed it there in response to a neighbor’s offensive and personally insulting language on yard signs.

The New York Times was the first to report on the news of the upside-down flag last week. This gesture has frequently been linked to the “stop the steal” movement, which is founded on unverified allegations of voter fraud in the 2020 election.

Democrats are expressing their outrage over the incident, deeming the reports as “alarming” and “appalling.” As a result, some Democrats are urging Justice Alito to recuse himself from cases related to the 2020 election and the January 6 insurrection, including former President Trump’s presidential immunity case.

In a statement, Cohen expressed his belief that the incident serves as a blatant and unapologetic display of political bias.

According to the lawmaker, the individual proudly displayed a flag in front of their house to show their support for the insurrectionists on January 6th. Furthermore, they have been involved in ongoing lawsuits related to the 2020 election and the insurrection, which directly violates the federal recusal statute and the ethics rules set by the Supreme Court.

“We need to ensure accountability in order to uphold the integrity and fairness of the High Court,” he emphasized. “Justice Alito must face censure for blatantly violating the law and court rules, and he should recuse himself from any further involvement in litigation concerning the 2020 election and the events of January 6th.”
