Mocobizscene- A lawsuit has been filed against the restaurant chain Roscoe’s Chicken and Waffles by a former employee. The employee claims that they were not paid for overtime work, did not receive compensation for missed meal and rest breaks, and experienced other labor-related problems.
Jaime Alejandro Carbajal-Torres, who worked for Roscoe’s from November 2001 until last March, is the plaintiff in a proposed lawsuit filed in the Los Angeles Superior Court. He aims to represent himself and other employees who have performed cleaning tasks, prepared and served beverages, and transferred meals to servers.
The lawsuit aims to obtain unspecified damages while also seeking injunctions to prohibit Roscoe’s from committing any additional alleged Labor Code violations. Additionally, the suit calls for the establishment of “appropriate and effective means” to prevent future alleged violations.
A representative from Roscoe’s did not respond immediately when asked for a comment regarding the lawsuit filed on Friday.
For at least four years leading up to the lawsuit filing and continuing up until now, Roscoe’s has neglected to compensate the plaintiff and other potential class members for overtime hours worked. These individuals have been putting in more than eight hours a day or 40 hours per week, and in some cases, even working seven days in a row.
According to the lawsuit, Roscoe’s failed to fully compensate the plaintiff and other employees for their wages upon termination or resignation.
Roscoe’s has six locations in Los Angeles County and one additional location in Anaheim, Orange County.
