A man’s capital murder charge was dropped three years after a woman’s body was discovered in a hospital parking lot

MONTGOMERY, Ala – The capital murder charge against James Burton Dunn, a man from Montgomery County, in connection with the shooting death of KeAira Battle has been dismissed.

In June 2020, Battle’s body was found outside the Elmore Community Hospital after being shot, and authorities believed she was shot in Montgomery before being taken to Wetumpka.

This case caused a stir as both Elmore and Montgomery county officials worked together to determine the lead agency in the “cross jurisdictional crime.”

Montgomery County District Attorney Daryl Bailey stated that his office had been provided with new evidence that led them to drop their charges, but he did not provide any further information about the evidence.

Bailey emphasized that his office is committed to seeking justice in every case, and he will be requesting the Montgomery Police Department to reopen the homicide investigation to examine the new evidence.
