Two additional men from Kansas City have been sentenced in federal court for their involvement in a drug-trafficking scheme that included violent crimes committed with illegal firearms. These crimes also included a drive-by shooting outside a daycare center where children were present. The men were part of a violent street gang.
David J. Duncan, IV, who is also known as “Deej” or “DJ,” and Gary O. Toombs were given their sentences on Tuesday, September 26th in separate court appearances. Duncan is 34 years old while Toombs is 43.
According to the U.S. Department of Justice, Duncan has been given a 30-year sentence in federal prison without the possibility of parole. Meanwhile, Toombs has been sentenced to 12 years and seven months in federal prison without the possibility of parole.
According to the verdict, Duncan and Toombs were convicted of being involved in a scheme to distribute heroin, cocaine, oxycodone, and marijuana from January 1, 2011, to October 1, 2019.
Two individuals involved in the conspiracy were sentenced on September 18th.
According to the Department of Justice, Smith and Duncan were popular rap artists who were recognized by their stage names “Dellio,” “Dog,” “Deej,” and “DJ.” Their social media profiles and YouTube videos depicted them with firearms and stacks of cash, along with other members of their group.
According to law enforcement officials, the 246 gang made use of a house situated in the 4400 block of Kensington, which is within a 1000-feet radius of George Washington Carver Dual Language School, for conducting their drug-trafficking and gang-related activities.
As per the records in the court documents, the law enforcement officials conducted a search warrant at the Kensington residence and confiscated two assault rifles, a stolen vehicle that was utilized in a drive-by shooting a month earlier, and a substantial quantity of 295 grams of heroin. It is believed that the drive-by shooting was carried out under the direction of Duncan. Subsequently, Duncan was taken into custody on October 2, 2019, from his apartment.
During the search, law enforcement officers discovered two firearms. One was a Glock 9mm semi-automatic pistol, which was found underneath the couch in the living room. The other firearm was also found in the living room, and it was a pistol. Additionally, a Glock .40-caliber was discovered in a kitchen cabinet.
During the trial, it was revealed that Toombs, Smith, and Franklin were involved in a plot to possess firearms in order to further their drug trafficking activities. As a result, all three individuals were convicted of this charge.
The sentencing of Duncan and Toombs marks the end of this case, with all defendants now having received their punishment. Along with the four who were convicted at trial, 14 others chose to plead guilty and have already been sentenced.
