Alabama Attorney General Steve Marshall has recently announced that the Circuit Court of Shelby County has granted his emergency request for a temporary restraining order against Legend Windows, LLC, along with its affiliates Jody Ray Whitworth, Bobby Ray Whitworth, and Robin Simmons Willard.
According to the Attorney General, Legend Windows and the individuals mentioned in the case have been accused of violating Alabama’s Deceptive Trade Practices Act (DTPA) by deceiving customers into paying deposits for windows and doors that were never provided. In response, Shelby County Circuit Judge William H. Bostick, III issued a temporary restraining order that included freezing the assets of the accused parties. This order was signed on Friday morning, with a preliminary injunction hearing set for July 8, 2024.
According to Attorney General Marshall, it’s high time for Legend Windows and the Whitworths to face the consequences of their deceitful acts. The scam they have been running for a considerable period, targeting their customers, needs to be put to an end. He further expressed his concern that these Defendants have a history of stealing properties and are unapologetic about their fraudulent actions. They have repeatedly committed such offenses without any remorse, and it’s time they face the music.
In Alabama, over 40 victims have been cited in the State’s complaint, which includes 42 violations of the DTPA. The complaint states that the defendants are liable to pay a total of $181,042.80 in damages to their victims. Furthermore, it accuses Jody Whitworth of misusing customers’ funds for personal expenses instead of delivering the services that the business promised.
From September 2022 to March 2024, the bank account of Legend Windows saw 1100 transactions on Amazon, amounting to almost $50,000 in total. Furthermore, the company spent over $20,000 on purchases from different retailers, such as Temu, Etsy, JC Penney, TJ Maxx, Ross, Marshalls, Scentsy, Plato’s Closet, Nordstrom, Kohl’s, and Burlington.
The Attorney General’s requests, including restitution for the victims, civil penalties, and the permanent closure of Legend Windows, LLC, are being considered by the court during the review of the case. As a result of the temporary restraining order, the defendants are not allowed to operate, and the individual defendants are permanently prohibited from operating in the general contracting industry in Alabama.
