The state’s Court of Appeal dismissed Metallica’s lawsuit on Monday, March 18. The band had filed the lawsuit in an attempt to claim over $3 million from their insurance company. According to Billboard, Metallica suffered a loss of $3,234,569 in May 2020, which included expenses such as $184,996 in payroll to support their crew members during the lockdown. However, when they approached the insurer for reimbursement, the company referred to a clause in their contract that stated that losses caused by “communicable diseases” were not covered.

In December 2022, the band’s lawsuit, which aimed to obtain reimbursement, was dismissed. The band appealed, claiming that a jury could hold a non-COVID reason responsible for the losses. However, Justice Maria Stratton countered, emphasizing that we are all well aware of the true reason behind the cancellations in the song “All Too Well.”

“It is ridiculous to believe that the government closures were not a direct consequence of the Covid-19 pandemic,” she expressed. “To borrow a phrase from Taylor Swift, ‘We were there. We remember it all too well.'” The judge further highlighted the insufficient availability of vaccines and N-95 masks during that period. Additionally, she mentioned the unsettling fact that New York City had to resort to using refrigerated trucks as temporary morgues, an image that remains vivid in our minds.”
