Court Uses Taylor Swift Lyric in Ruling on Metallica Insurance Lawsuit

A California judge recently invoked Taylor Swift while rejecting a fellow musician’s plea to move forward with a trial.

The state’s Court of Appeal dismissed Metallica’s lawsuit on Monday, March 18. The band had filed the lawsuit in an attempt to claim over $3 million from their insurance company. The amount represented the losses incurred due to the cancellation of six South American concerts. Originally, these concerts were postponed in 2020 but were later canceled due to the COVID-19 pandemic.

According to Billboard, Metallica suffered a loss of $3,234,569 in May 2020, which included expenses such as $184,996 in payroll to support their crew members during the lockdown. However, when they approached the insurer for reimbursement, the company referred to a clause in their contract that stated that losses caused by “communicable diseases” were not covered.

In December 2022, the band’s lawsuit, which aimed to obtain reimbursement, was dismissed. The band appealed, claiming that a jury could hold a non-COVID reason responsible for the losses. However, Justice Maria Stratton countered, emphasizing that we are all well aware of the true reason behind the cancellations in the song “All Too Well.”

“It is ridiculous to believe that the government closures were not a direct consequence of the Covid-19 pandemic,” she expressed. “To borrow a phrase from Taylor Swift, ‘We were there. We remember it all too well.'” The judge further highlighted the insufficient availability of vaccines and N-95 masks during that period. Additionally, she mentioned the unsettling fact that New York City had to resort to using refrigerated trucks as temporary morgues, an image that remains vivid in our minds.”

The impact of the common clause has not been limited to Metallica alone. Many other performers, venues, and businesses have also suffered due to the travel and gathering restrictions imposed during the pandemic. Numerous cases similar to that of the band have been dismissed, but there is still one pending lawsuit from Live Nation. This massive lawsuit seeks coverage for over 10,000 shows and a staggering 15 million tickets that were affected by the pandemic.
