Additional 7 states join in legal action to halt Biden’s proposed student loan relief program amidst growing number of lawsuits

President Biden’s administration is currently dealing with yet another lawsuit as several states, including Missouri, are actively trying to prevent the implementation of his student loan handout plan. On Tuesday, Missouri, along with six other states, filed a complaint in this regard.

Missouri Attorney General Andrew Bailey has filed a lawsuit challenging the legality of President Biden’s “SAVE” plan. According to Bailey, this plan, which was announced in February, would impose a financial burden of $475 billion on American taxpayers. It is worth noting that this lawsuit follows a similar legal action taken by Kansas and 10 other states against the Biden administration regarding the same plan.

In a statement to Fox News Digital, Bailey expressed his concern over President Joe Biden’s decision to burden working Missourians with a debt of half a trillion dollars through the stroke of his pen. Bailey pointed out that the United States Constitution clearly states that the President does not have the authority to unilaterally cancel student loan debt for millions of Americans without express permission from Congress.

“The President cannot disregard the Constitution to further his political agenda. I am taking legal action to stop his shameful attempt to manipulate the 2024 election, which clearly violates the law. As long as I hold the position of Attorney General, the Constitution will always carry significance.”

More student loan forgiveness is on the horizon as U.S. colleges commit to cost transparency.

President Biden’s student loan forgiveness plan is facing yet another lawsuit, as well as opposition from a growing number of states. On Tuesday, Missouri and six other states filed a lawsuit against the plan. This development adds to the challenges President Biden’s administration is facing in their efforts to implement this policy.

Bailey is joined in the lawsuit by attorneys general from Arkansas, Florida, Georgia, Ohio, Oklahoma, and North Dakota.

Missouri and Arkansas were actively involved in the lawsuit that ultimately resulted in the overturning of Biden’s previous student loan plan last year. The Supreme Court, in a 6-3 decision, ruled that Biden’s plan was unconstitutional.

According to Arkansas AG Tim Griffin, President Biden has already faced defeat on this issue before and is now disregarding the law. Griffin emphasizes that the Supreme Court’s ruling was unequivocal: President Biden does not have the authority to unilaterally eliminate student debt and burden taxpayers with the immense financial burden.

Missouri and Arkansas were actively involved in the lawsuit that resulted in the termination of Biden’s previous student loan forgiveness plan last year. The Supreme Court made a decisive 6-3 ruling, declaring the plan unconstitutional.

According to the lawsuit, Biden’s SAVE plan is seen as a continuation of a concerning trend where the President utilizes seemingly harmless language from outdated laws to enforce significant and expensive policy alterations on the American populace, all without their consent.

The White House has not yet responded to a request for comment from Fox News Digital. However, the Biden administration has previously defended the SAVE program against the lawsuit led by Kansas.

“The Department refrains from commenting on ongoing legal cases. Nevertheless, in 1993, Congress granted the U.S. Department of Education the power to establish the parameters of income-driven repayment plans. The SAVE plan, being the fourth instance of exercising this authority, was implemented,” stated an Education Department representative. They further added, “The Biden-Harris Administration remains committed to relentlessly assisting and easing the burden for borrowers nationwide, irrespective of the repeated attempts by Republican elected officials to impede our efforts.”

Some borrowers of student loans are receiving refunds in addition to having their loans forgiven.

President Biden’s attempts to forgive student loans through executive action have been repeatedly blocked by the Supreme Court.

On Tuesday, a lawsuit was filed, coinciding with Biden’s recent announcement of a new plan to address the issue of student loan debt. The plan specifically targets loans that have accumulated interest beyond their original principal amount. Under this proposal, borrowers would have the opportunity to reduce up to $20,000 in accrued interest. Additionally, individuals earning less than $120,000 or couples with a combined income of less than $240,000 would be eligible to have all of their interest beyond the principal amount waived.
