JACKSON COUNTY, AL– A Jackson County grand jury has indicted a Section man for the death of his father three months ago.
Byron Heath Shavers, 49, was arrested in May after the Jackson County Sheriff’s Office (JCSO) investigated his father, 74-year-old Joe Bob Shavers Jr., and identified him as a suspect.
Around 11:40 a.m. on Mother’s Day, JCSO Deputies and a Powell Police Department (PPD) officer came at the Shavers’ home on County Road 19 in Section for a welfare check.
Joe Bob Shavers was discovered dead inside the residence with “apparent trauma to his head.” Bryon Shavers is accused of hitting his father in the head with a blunt object, according to the indictment.
According to court records, he was refused bond during an Aniah’s Law hearing on May 25.
Shaver’s’ defence team has now requested a court-ordered mental assessment, claiming that the 49-year-old has a “prior history of mental incompetence, to wit: delusions, erratic behaviour, and inability to care for himself.”
Shaver, according to defence attorney James Mick, “lacks the ability to understand the charges against him or the proceedings in the case.” He also lacks the ability to consult with his lawyers enough.”
The court papers demanding the examination mention Shaver’s pleading not guilty by reason of mental sickness or defect.
An arraignment set for August 2 has been pushed up until October 4.
