Court records indicate that a man from Montgomery who was previously indicted on a capital murder charge has decided to plead guilty to a lesser charge of manslaughter. This information was reported by WSFA.
In September 2017, John Grant was accused of using a shotgun to shoot Earl Mock at close range while Mock was inside his vehicle. Shockingly, Mock remained on life support for almost 15 months before being taken off life support and passing away on December 26, 2018, at the age of 45.
In 2022, Grant’s attorneys attempted to have the capital murder charge against him dismissed by citing the “year-and-a-day rule.” This rule, which dates back centuries, stated that homicide prosecutions were only viable if the victim died within one year and one day of the criminal act. However, Grant’s motion was ultimately denied.
On Tuesday, Grant admitted to manslaughter charges and received a 17-year prison sentence without delay.
