Operations of ‘Legend Windows’ suspended by court, assets frozen over allegations of fraud

A company by the name of ‘Legend Windows’ has had its operations suspended and assets frozen due to allegations of fraud. This action was taken by the court in response to the claims made against the company.

On Friday, Steve Marshall, the Attorney General of Alabama, declared that the Circuit Court of Shelby County has approved his urgent plea for a temporary restraining order against Legend Windows, LLC and its associated individuals, including Jody Ray Whitworth, Bobby Ray Whitworth, and Robin Simmons Willard.

According to Marshall, Legend Windows, the Whitworths, and Willard have breached Alabama’s Deceptive Trade Practices Act (DTPA) by deceiving customers into submitting deposits for new windows and doors, but failing to provide the promised goods.

According to Attorney General Marshall, the Whitworths and Legend Windows have been carrying out this fraudulent scheme for an extended period, targeting innocent customers. It is high time for them to be held responsible for their illegal activities. The defendants have a history of stealing properties, and they have not shown any remorse for their actions. Instead, they continue to engage in fraudulent practices, repeatedly perpetuating their offenses.

On July 8, 2024, there will be a preliminary injunction hearing. As of now, there is a temporary restraining order in place which also involves an asset freeze.

According to the state, there are 42 violations of the DTPA and more than 40 victims scattered throughout Alabama. The complaint also states that the victims are owed a total of $181,042.80 in damages by the business.

The customers have alleged that Jody Whitworth misused their money by buying personal items instead of fulfilling the promised products and services as advertised by the business.

From September 2022 to March 2024, the Legend Windows bank account was utilized to make more than 1100 purchases from Amazon, amounting to almost $50,000. Alongside this, the business also spent over $20,000 on purchases from various retailers such as Temu, Etsy, JC Penney, TJ Maxx, Ross, Marshalls, Scentsy, Plato’s Closet, Nordstrom, Kohl’s, and Burlington during the same time frame. Marshall confirmed these details.

The court has granted Marshall’s requests for a temporary restraining order against the defendants, which prohibits them from operating while the matter is being reviewed. Marshall is seeking various forms of relief, including restitution for the victims, civil penalties, the permanent closure of Legend Windows, LLC, and an injunction that would prevent the individual defendants from ever operating in the general contracting industry in Alabama again.
