Starting July 1, bars in California must provide date rape drug testing kits as a mandatory requirement

Starting July 1, 2023, bars and clubs in California will be required to provide date rape drug testing kits as per AB 1013, a law that was unanimously passed. This mandate aims to ensure the safety of patrons who consume alcohol in these establishments.

To comply with the law, the test kits should have the ability to detect flunitrazepam, commonly known as “roofies”, ketamine, and gamma hydroxybutyric acid. The bars and nightclubs that hold Type 48 licenses are not responsible for the accuracy of the test kits, provided they have not expired. A pack of ten test strips can be purchased for around $15.

Alcohol Justice has issued a statement in support of the bill, stating that surveys have shown that anywhere from 6% to 25% of individuals have had a drug unknowingly put into their drink. Even the lowest rate of 1 in 20 means that on any given Friday night at a bar, there is at least one person present who has been or will be a victim of having their drink spiked.

According to the California Department of Alcohol and Beverage Control, breaking this law may not result in criminal charges, but it could lead to administrative citation against the license.
